5. Customer responsibilities

If you become a customer, you are responsible for:

providing accurate information and lawful instructions ensuring you have rights and permissions to any data, content, contact lists, phone numbers, or materials you provide to us or use through the service complying with all laws applicable to your business communications, including privacy, spam, telemarketing, and consumer laws maintaining the confidentiality of account credentials reviewing automated communications and workflows before live use where applicable ensuring your own website, policies, consents, and notices are appropriate for your businessYou must not use the services for unlawful, misleading, harassing, deceptive, or abusive conduct.

All fees are non-refundable except as required by law or as expressly stated in writing.

Optional free trial clause:
If we offer a free trial, the trial is subject to the terms stated at sign-up. We may change or withdraw a trial offer at any time. At the end of a trial, paid fees may apply unless you cancel before the trial ends, where that billing flow has been clearly disclosed.

8. Consumer guarantees

Nothing in these Terms excludes, restricts, or modifies any rights or remedies you may have under the Australian Consumer Law or other laws that cannot be excluded.

Where permitted by law, our liability for a breach of a non-excludable guarantee is limited, at our option, to resupplying the services or paying the cost of having the services resupplied.

To the maximum extent permitted by law, our total aggregate liability arising out of or in connection with the website or services is limited to the amount you paid us for the relevant services in the 3 months before the event giving rise to the claim, or, if no amount was paid, AUD $100.

This clause does not apply to liability that cannot be excluded or limited by law.
